Blackheart Privacy Policy

This Privacy Policy explains how Blackheart LLC ("Blackheart," "we," "us," or "our") collects, uses, shares, and protects information when you use the Blackheart mobile application (the "App") and the Blackheart website at www.blackheart.dating (together, the "Service").
Blackheart is a dating and social-matching service intended only for adults 18 years of age or older. By creating an account or using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please do not use the Service.
1. Summary of what we collect and why
At a glance, we collect: (a) information you give us when you register and build your profile; (b) a facial-liveness scan used only to confirm you are a real, live person; (c) content and interactions you create in the App (photos, prompts, ratings, messages, reports); and (d) technical and usage information generated as you use the Service. We use this information to operate the matching and messaging features, verify identity, keep the community safe, provide premium features, and comply with the law. Details follow.
2. Information you provide to us
Account and identity information. To create an account you provide a mobile phone number (used as your sign-in identifier and verified by SMS one-time code), a password, your first name (shown on your profile), your last name (kept private and never displayed to other users), and your date of birth (kept private; only your derived age is shown). We require your date of birth to confirm you are 18 or older; your name and birth date are permanent once your account is created.
Profile information. As you build your profile you may provide: gender identity and who you are seeking; height; ethnicity; occupation/work and education (level and institution); relationship preferences (for example, monogamous or polyamorous; casual or intentional; short-term or long-term); religion; political views; substance-use habits; whether you have or want children; hobbies and interests; activity level; and your city and state (approximate location that you enter yourself — we do not collect precise GPS location). Some of these categories may be considered sensitive in your jurisdiction; you choose what to share, and you can edit or remove most of them at any time.
Photos and prompts. You may upload profile photos and answer written prompts. These appear on your public profile to other users.
Payment information. If you purchase a premium subscription or pass, the transaction is processed by Apple through the App Store. We do not receive or store your credit-card or payment-card numbers. We receive a confirmation that a purchase occurred (including a signed transaction identifier and product identifier) so we can activate premium features and manage expiration.
Communications. If you contact us for support or through our website contact form, we receive the information you send us (such as your name, email, and message).
3. Biometric information (facial verification)
To help keep the community authentic and safe, Blackheart offers or requires an identity-verification step that uses facial-recognition "liveness" technology to confirm that you are a real, live person and, where applicable, that your selfie matches your profile photos. This process may involve the capture and analysis of a facial scan or facial geometry, which may be considered biometric information or a biometric identifier under laws such as the Illinois Biometric Information Privacy Act (BIPA) and similar state laws.
- What we collect: a short facial-liveness capture (image/video frames) and, from it, facial-geometry data used solely to verify liveness and identity.
- Purpose: solely to verify that you are a genuine, live adult and to reduce fraud, impersonation, and fake accounts. We do not use biometric data for advertising, profiling, or any purpose other than verification and safety.
- Processor: the liveness analysis is performed with the help of Amazon Web Services as our service provider. AWS processes this data on our behalf under contract and is not permitted to use it for its own purposes.
- Consent: we ask for your consent before capturing biometric data, and you may decline (though some features may then be unavailable).
- Retention and destruction: we retain biometric identifiers and biometric information only as long as needed to fulfill the verification purpose, and in any event we will permanently destroy them when the initial purpose has been satisfied or within three (3) years of your last interaction with us, whichever occurs first, and upon deletion of your account. We retain a record that your identity was verified and, where applicable, a verified profile photo; the facial-geometry data used for the liveness check is processed only transiently by our verification provider to complete the check and is not retained by Blackheart thereafter.
- No sale or disclosure: we do not sell, lease, trade, or profit from your biometric information, and we do not disclose it except to our processor above, as required by law, or with your consent.
4. Information we collect automatically
- Interaction data: ratings you give and receive (numeric scores), red-flag reports and blocks, matches, messages, GIFs you send, and typing status. This activity powers matching, safety, and the ranking of profiles.
- Usage and activity data: the dates you are active in the App (used for ranking and to show relevant profiles), features you use, and general diagnostic and log data.
- Device and technical data: device type and operating-system version, app version, a push-notification token (to deliver notifications), and IP address (from which an approximate, coarse location may be inferred for security and localization).
- Website data: our website is hosted on Squarespace, which may use cookies and similar technologies for basic functionality and analytics. See Section 11.
5. How we use your information
We use the information described above to:
- create and operate your account and profile;
- match you with other users and power the discovery, ranking, and "dating pool" features;
- enable messaging, reactions, and other interactions;
- verify identity and prevent fraud, impersonation, and fake accounts;
- keep the community safe — including reviewing reports, moderating photos and content, and enforcing our Terms (see also our zero-tolerance policy below);
- provide, activate, and manage premium subscriptions and passes;
- send you service-related and (where permitted) promotional notifications;
- analyze and improve the Service; and
- comply with legal obligations and enforce our agreements.
Zero tolerance. Blackheart maintains a zero-tolerance policy for objectionable content and abusive behavior. We use the information above — including reports, blocks, and automated photo moderation — to detect and remove violating content and users, consistent with our Terms of Service.
6. How your information is shared
With other users. Your public profile (for example, first name, age, photos, prompts, and the profile details you choose to share) is visible to other users you may match with. Your last name, exact date of birth, phone number, and biometric data are not shown to other users.
With service providers (processors). We share information with vendors who process data on our behalf under contract, including: - Google / Firebase — authentication, database, file storage, cloud functions, real-time messaging, push notifications, and automated photo moderation (Google Cloud Vision); - Amazon Web Services — facial-liveness/identity verification (see Section 3); - Apple — in-app purchases and push-notification delivery; - Giphy — GIF search (when you search for a GIF, your query is sent to Giphy to return results).
For legal and safety reasons. We may disclose information if we believe in good faith that it is necessary to comply with law or legal process, enforce our Terms, protect the rights, safety, or property of Blackheart, our users, or the public, or investigate fraud or abuse.
Business transfers. If Blackheart is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Privacy Policy.
We do not sell your personal information, and we do not "share" it for cross-context behavioral advertising as those terms are defined under California law.
7. Data retention
We keep your personal information for as long as your account is active or as needed to provide the Service. When you delete your account, we delete or de-identify your personal information within a commercially reasonable period, except where we must retain certain information to comply with legal obligations, resolve disputes, prevent fraud and abuse, or enforce our agreements. For example, we may retain limited records of reports, red flags, and blocks to keep the community safe and to prevent banned users from returning. Biometric information is retained and destroyed as described in Section 3.
8. Your rights and choices
Access, correction, and deletion. You can review and edit most profile information directly in the App. You can delete your account at any time from within the App, which removes your profile from the Service.
Requests. Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to appeal a decision. To make a request, contact us at blackheart@blackheart.dating. We will verify your request and respond as required by applicable law. We will not discriminate against you for exercising these rights.
Notifications. You can control push notifications in your device settings.
9. California privacy rights (CCPA/CPRA)
If you are a California resident, you have the right to know the categories and specific pieces of personal information we collect, the purposes for collection, and the categories of third parties with whom we share it; to request deletion or correction; and to be free from discrimination for exercising your rights. We collect the categories of personal information described in this Policy, including sensitive personal information such as your precise account identifiers, biometric information used for verification, and information about certain characteristics you choose to provide. We use sensitive personal information only for the purposes described here (identity verification, safety, and operating the Service) and not to infer characteristics for advertising. We do not sell or share (for cross-context behavioral advertising) personal information. To exercise your rights, contact blackheart@blackheart.dating.
10. GDPR / international users
If you use the Service from outside the United States, your information will be processed in the United States, where privacy laws may differ from those in your country. If you are in the European Economic Area, the United Kingdom, or a similar jurisdiction, our legal bases for processing include: performance of our contract with you (to provide the Service), your consent (for example, for biometric verification and certain optional data), our legitimate interests (safety, fraud prevention, and improving the Service), and compliance with legal obligations. You may have rights to access, rectify, erase, restrict, or object to processing, and to data portability; contact blackheart@blackheart.dating.
11. Cookies and the website
The Blackheart website (www.blackheart.dating) is built and hosted on Squarespace, which may set cookies and use similar technologies for essential site functionality, security, and analytics. You can control cookies through your browser settings. The Blackheart mobile App itself does not use web cookies, though it uses similar local identifiers and the technical data described above.
12. Security
We use reasonable technical and organizational measures to protect your information, including encryption of data in transit, access controls, and server-side enforcement of sensitive account fields. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please protect your account by keeping your credentials confidential.
13. Children
Blackheart is strictly for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from a person under 18, we will delete it and terminate the account. If you believe a minor is using the Service, contact us at blackheart@blackheart.dating.
14. Changes to this Policy
We may update this Privacy Policy from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice (for example, in the App or by email). Your continued use of the Service after an update means you accept the revised Policy.
